In these Terms, “MGF d.o.o., Ljubljana”, “MGF”, “Seller” or “Site” means the operator of www.mgftools.eu.

These Terms of Use govern access to and use of www.mgftools.eu, the General Terms and Conditions of Sale, and the Privacy Policy.

By browsing the Site, creating an account, or purchasing a product, the user confirms that they have read, understood, and accepted these Terms of Use.

MGF d.o.o., Ljubljana, may modify or update these Terms of Use anytime. The version published on the Site is the version in force. Users should regularly check this page.

The Privacy Policy applies even when the user visits the Site without purchasing anything.

2. Intellectual Property Rights

All content on the Site, including but not limited to texts, technical information, documents, graphics, logos, icons, images, audio/video files, software, source code, layout and design, is the property of MGF d.o.o., Ljubljana or is used with the authorisation of the relevant right-holder.

No content of the Site may be copied, reproduced, translated, modified, distributed, transmitted, downloaded, published or otherwise used, in whole or in part, without the prior written consent of MGF d.o.o., Ljubljana, except for strictly personal and non-commercial use.

The names “MGF”, “MGF d.o.o., Ljubljana”, “MGF Tools” and related logos are protected trademarks. Any unauthorised use of these or other distinctive signs will be prosecuted to the fullest extent permitted by law.

It is forbidden to copy or attempt to copy the Site’s software, scripts or source code, to carry out reverse engineering, scraping or automated data extraction without authorisation.

3. Website Content and Availability

MGF d.o.o., Ljubljana takes reasonable care to ensure that the information published on the Site is accurate, up to date and complete. However, technical, typographical or photographic errors may occur. The Site and its contents are provided “as is.”

MGF d.o.o., Ljubljana may, at any time and without notice:

  • change or update the content of the Site,

  • suspend or limit access to all or part of the Site,

  • disable certain functions or services.

MGF d.o.o., Ljubljana, is not liable for any damage or loss suffered by the user or by third parties as a result of:

  • temporary unavailability or malfunction of the Site,

  • the presence of viruses or malicious code that cannot reasonably be prevented.

5. Use of the Site and User Accounts

Some areas or services of the Site may require registration or creating a user account.

When registering, the user undertakes to:

  1. provide true, accurate and complete data,

  2. keep such data up to date,

  3. keep login credentials confidential and do not share them with third parties,

  4. use the Site in a lawful manner and in accordance with these Terms.

The user is solely responsible for any activity carried out through their account. If the user suspects unauthorised use, they must immediately inform MGF d.o.o., Ljubljana.

The user undertakes not to:

  • upload or transmit content that is unlawful, offensive, defamatory, discriminatory, or that violates third-party rights (including IP rights),

  • interfere with the proper functioning of the Site or attempt to bypass its security systems,

  • use the Site in a way that could damage, disable or overload the infrastructure.

MGF d.o.o., Ljubljana, may, at its discretion and without prior notice, suspend or close a user account and/or block access to the Site if it detects violations of these Terms or unlawful use.

MGF d.o.o., Ljubljana shall be indemnified and held harmless by the user from any claim, damage, loss or cost arising from content or actions attributable to that user.

6. Privacy and Personal Data

Personal data collected through the Site is processed by MGF d.o.o., Ljubljana as data controller, in accordance with:

  • Regulation (EU) 2016/679 (GDPR),

  • the applicable Slovenian data-protection rules (including ZVOP-2),

  • the Privacy Policy published on the Site.

The Privacy Policy explains what data are collected, for which purposes, on what legal basis, how long they are kept and what rights the data subject has (access, rectification, erasure, restriction, objection, portability). Users are invited to read it carefully.

7. Relationship with the General Terms and Conditions of Sale

These Terms of Use regulate access to and browsing of the Site.

The purchase of Products through the Site is additionally governed by the General Terms and Conditions of Sale published on the Site. In the event of conflict between these Terms of Use and the General Terms and Conditions of Sale regarding an online purchase, the General Terms and Conditions of Sale shall prevail.

8. Applicable Law and Jurisdiction

The law of the Republic of Slovenia governs these Terms of Use.

If the user is a consumer resident in the EU, the mandatory consumer-protection rules of the user’s country of residence also apply.

Any dispute arising out of the interpretation or application of these Terms of Use, and not amicably settled, shall fall under the exclusive jurisdiction of the competent courts in Ljubljana, Slovenia, without prejudice to the consumer’s right to bring the case before the court of their domicile where mandatory rules so provide.
